International Criminal Court Updates (February 2020)


Afghanistan

On March 5th, the ICC’s Appeals Chamber will deliver the judgment in the appeal of the Prosecutor against a Pre-Trial Chamber’s unanimous rejection of the Prosecutor’s request to proceed with an investigation into alleged crimes against humanity and war crimes committed in Afghanistan since 2003.

The hearing will be livestreamed on the ICC website, where further details about the preliminary examination into the situation in Afghanistan can also be found.


Palestine

The Prosector’s preliminary examination into the situation in Palestine continues, with Palestine, Israel, victims in the situation, other states, and organizations invited to submit written observations related specifically to the question of jurisdiction. The Prosecutor is scheduled to file a response to the observations by the end of March.

Canada has reportedly submitted a letter to the ICC reiterating its position that Canada does not recognize the Palestinian state and does not believe that the court has jurisdiction in this case.


Darfur, Sudan

Although the Sudanese government has made vague statements regarding the possibility of former President Omar Al Bashir appearing before the ICC, the case officially remains at the pre-trial stage at the ICC, because Al Bashir is not in their custody.
